General conditions of contract

GENERAL CONDITIONS OF CONTRACT
This contractual document will govern the hiring of rental apartments and tourist services through the website www.casaspepe.com, owned by APARTAMENTOS CASAS PEPE SA, under the trademark of CASAS PEPE, hereinafter, PROVIDER, whose contact details also appear in the Legal Notice of this Website.

These Conditions will remain published on the website available to the USER to reproduce and save them as confirmation of the contract, and may be modified at any time by the PROVIDER. It is the responsibility of the USER to read them periodically, since those that are in force at the time of placing orders will be applicable.

Contracts shall not be subject to any formality except in the cases expressly indicated in the Civil and Commercial Codes and in this or other special laws.

The acceptance of this document implies that the USER:

  • You have read, understand and understand what is stated here.
  • It is a person with sufficient capacity to hire.
  • You assume all the obligations set forth herein.

These conditions will have an indefinite period of validity and will be applicable to all contracts made through the PROVIDER's website.

The PROVIDER informs that the trade is responsible and knows the current legislation of the countries to which it offers its services and reserves the right to unilaterally modify the conditions, without affecting the goods or promotions that were contracted prior to the modification.

Identity of the contracting parties

On the one hand, the PROVIDER of the apartment rental and tourist services service contracted by the USER is APARTAMENTOS CASAS PEPE SA, with registered office at Avenida de Bonn 1, 35100, Playa del Inglés, San Bartolomé de Tirajana (LAS PALMAS), NIF A35061092 and with customer service telephone / USER 928762818.

Object of the contract

The purpose of this contract is to regulate the contractual relationship between the PROVIDER and the USER at the moment in which the latter accepts, during the online contracting process, the rental of apartments and services for holiday use.

The contractual relationship of booking accommodation entails the rental of an apartment in the chosen category, for a limited time, in exchange for a certain price and publicly displayed through the website. Extra services must be contracted at the time of booking.

Contracting procedure

The USER, in order to access the services or products offered by the PROVIDER, must be of legal age. Therefore, the USER must freely and voluntarily provide the personal data that will be required, which will be treated in accordance with the provisions of Regulation (EU) 2016/679, of April 27 (GDPR), and Organic Law 3/2018, of December 5 (LOPDGDD), detailed in the Legal Notice and Privacy Policy of this website.

It is reported that in accordance with the requirements of article 27 of Law 34/2002, on Services of the Information Society and Electronic Commerce (LSSICE), the contracting procedure will follow the following steps:

1. GENERAL CONTRACTUAL CLAUSES

Unless otherwise stipulated in writing, the making of a reservation to the PROVIDER will imply acceptance by the USER of these legal conditions. No stipulation made by the USER may differ from those of the PROVIDER if it has not been expressly accepted in advance and in writing by the PROVIDER.


2. ACTIVATION OF RESERVATIONS AND PAYMENT

The PROVIDER will previously inform the USER about the procedure to be followed to make the reservation of the trip.

The automatic system of calculation of availability and prices allows the USER to choose the category of apartment that interests him and immediately make the online payment.

Failure to perform the distance contract

The PROVIDER will not assume any responsibility when the activation of the service does not take place, because the data provided by the USER is false, inaccurate or incomplete.


3. CANCELLATIONS (right of withdrawal)

The USER has the same rights and deadlines to proceed with the cancellation and / or claim the possible vices or defects that the reservation presents, both online and offline.

Any cancellation must be communicated to the PROVIDER, requesting a return locator through the form provided for it, or by email to booking@casaspepe.com, indicating the corresponding reservation number. Any cancellation will be associated with the aforementioned cancellation conditions.


4. COMPLAINTS AND ONLINE DISPUTE RESOLUTION

Any claim that the USER deems appropriate will be addressed as soon as possible, and may be made at the following contact addresses:

If during the rental period there is a breakdown in the electrical installations or appliances, the USER must immediately notify the PROVIDER to resolve these incidents as soon as possible.

In case of force majeure (damage caused by water, fire, etc.), the PROVIDER will replace the reserved accommodation with another of the same characteristics. In the case of not having availability of accommodation, the PROVIDER will refund the total amount delivered.

Online Dispute Resolution

In accordance with Art. 14.1 of Regulation (EU) 524/2013, the European Commission provides a free access platform for the resolution of online conflicts between the USER and CASAS PEPE, without the need to resort to the courts of justice, through the intervention of a third party, called the Dispute Resolution Body, which acts as an intermediary between them. This body is neutral and will dialogue with both parties to reach an agreement, finally being able to suggest and / or impose a solution to the conflict.

5. FORCE MAJEURE

The parties shall not incur liability for any fault due to force majeure. The fulfillment of the obligation will be delayed until the cessation of the case of force majeure.


6. COMPETITION

The USER may not assign, transfer or transmit the rights, responsibilities and obligations contracted.

If any provision of these conditions is considered null or impossible to fulfill, the validity, legality and fulfillment of the rest will not be affected in any way, nor will they suffer modification in any way.

The USER declares to have read, know and accept these General Conditions in their entirety.


7. OVERVIEW OF THE OFFER

The details of each reservation, such as accommodation and diet, are informed to the USER in their respective description on the website.

All sales and deliveries made by CASAS PEPE will be understood to be subject to these General Conditions.

No modification, alteration or agreement contrary to the Commercial Proposal of CASAS PEPE or stipulated herein will take effect, unless expressly agreed in writing signed by CASAS PEPE, in this case, these particular agreements will prevail.

Given the continuous technical advances and improvements of the products, CASAS PEPE reserves the right to modify its specifications regarding the information provided in its advertising, until it does not affect the value of the services offered. These modifications will also be valid in the event that, for any reason, the possibility of providing the services offered is affected.

Inputs and outputs

Check-in: Check-in time is from 09:00 to 17:00 at our location at Avenida de Bonn 1, 35100; Playa del Inglés, San Bartolomé de Tirajana (LAS PALMAS).

  • The delivery of keys to the apartment will be at 14 hours. Please note that check-in does not guarantee the right to access the apartment.
  • If you arrive before 2 pm, you can check in and leave your luggage at Reception.
  • In case of arrivals outside the hours of the reception service, the client must contact through the booking@casaspepe.com mail to be informed about the procedure of access to the apartment.

Upon arrival at the complex and in accordance with current legislation, the USER must present the personal documentation of all the occupants of the reservation to generate the files for the relevant authorities.

Departures: The maximum allowed time of stay in the apartment is until 11 am on the day of departure.

Customer Responsibilities

- The USER undertakes to respect the regulations of the complex. During the hours of rest from 22:00 to 9:00, it is not allowed to use the apartments for party celebrations, or to make noise. In no case is it allowed to occupy the apartment by more people or by people other than those registered on arrival.

- The USER is responsible for the correct behavior of all occupants of the reservation, otherwise, the PROVIDER reserves the right to expel the occupants from the accommodation, without the right to future claims or any type of compensation.

- Neither CASAS PEPE, nor the owner will be responsible for any direct or indirect damage that may be caused as a result of the misuse of the accommodation, including without limitation: damage, loss after fire, theft, crime, accidents or other types of damages.


8. PRICE AND PERIOD OF VALIDITY OF THE OFFER

The prices indicated for each reservation include the IGIC Canary Islands General Indirect Tax. These prices, unless expressly stated otherwise, do not include other additional services and annexes to the service purchased.

The prices applicable to each property are those published on the website and will be expressed in the EURO currency. The USER assumes that the economic valuation of some of the services may vary in real time. Prices may change daily while the reservation is not made.

All payments made to CASAS PEPE entail the issuance of an invoice under consent (art. 63.3 RD 1/2007) in the name of the registered USER or the company name that he has informed at the time of placing the order. This invoice will be delivered to the USER when the stay ends and the payment of the contracted services is made. If you want to receive it by email, you must request it by any of the means that the PROVIDER makes available to you, informing you that at any time you can revoke said decision.

9. PAYMENT METHODS, CHARGES AND DISCOUNTS

The PROVIDER is responsible for economic transactions and enables the following ways to make the payment of a reservation:

  • Credit card.

Security measures

The website uses information security techniques generally accepted in the industry, such as SSL, data entered on a secure page, firewalls, access control procedures and cryptographic mechanisms, all in order to prevent unauthorized access to data. To achieve these purposes, the USER accepts that the PROVIDER obtains data for the purpose of the corresponding authentication of access controls.

The PROVIDER undertakes not to allow any transaction that is or is considered illegal by the credit card brands or the acquiring bank, which may or has the potential to harm their goodwill or negatively influence them.

The following activities are prohibited under card brand programs: the sale or offering of a product or service that does not comply with all laws applicable to the Buyer, Issuing Bank, Merchant or Cardholder or cards.


10. PURCHASE PROCESS

The website has a search system by different parameters to facilitate the choice of accommodation. Types of reservations:

  • Book with immediate confirmation: You can make the reservation online and add the extra services that suit you.
  • Price not available: In the case of not having the price of the service, the USER will be informed as soon as possible, by email or telephone.

Select the dates of entry and exit, the people staying (adults) and the extra services chosen and add to the basket. In this, only the selected services, quantity, price and total amount will be observed. Once the basket is saved, taxes, charges and discounts will be calculated according to the data entered.

The baskets have no administrative link, it is only a section where you can simulate a budget without any commitment by both parties.

From the basket you can place an order by following the following steps for its correct formalization:

1. - Verification of billing data.2. - Verification of the reservation (dates, services...). 3. - Selection of the payment method.4. - Place the order (buy).

Once the order has been processed, the system instantly sends an email to the management department of the PROVIDER and another to the USER's email confirming the completion of the order.

In a maximum of 24 hours, on working days, an email will be sent to the USER confirming the status of the reservation, as well as all the relevant information.

Payment facilities:

Make your reservation now and choose between two convenient payment methods to confirm the reservation:

  • Full payment of the stay
  • Initial payment 30% of the total stay and 70% remaining 30 days before your arrival. For this you will be sent a reminder email with the instructions to make the second payment.

Cancellation fees:

  • From today up to 60 days before arrival flexible cancellation (less management fees 10% of the reservation).
  • From 59 to 30 days before arrival, 30% of the total stay.
  • From 29 to 15 days before arrival, 50% of the total stay.
  • From 14 to 7 days before arrival, 70% of the total stay.
  • From 6 days until the day of arrival, 100% of the total stay.

 

11. DISSOCIATION AND SUSPENSION OR TERMINATION OF THE CONTRACT

If any of these terms and conditions are held to be unlawful, void or for any reason unenforceable, this condition shall be deemed severable and shall not affect the validity and enforceability of any remaining terms.

The PROVIDER may, without prior notice, suspend or terminate the USER's access to its services, in whole or in part, for any valid reason, including, without limitation, when the USER does not comply or follow any of the obligations established in this document or any legal provision, license, regulation, directive, code of practices or applicable use policies.

When the PROVIDER exercises any of its rights or faculties under this Clause, such exercise will not prejudice or affect the exercise of any other right, faculty or remedy that may be available to The PROVIDER.


12. WARRANTIES AND RETURNS

The guarantee of the services offered will respond to the following articles based on Royal Legislative Decree 1/2007, of November 16, which approves the revised text of the General Law for the Defense of Consumers and Users and other complementary laws:

Conformity of services with the contract

1. Unless proven otherwise, the services shall be deemed to be in conformity with the contract provided that they meet all the requirements set forth below, unless due to the circumstances of the case, any of them is not applicable:

a) They conform to the description made by CASAS PEPE.b) Are suitable for the uses to which the services of the same type are ordinarily destined.c) Are suitable for any special use required by the USER, when he has informed CASAS PEPE at the time of the conclusion of the contract, provided that he has admitted that the service is suitable for this use.d) Present the usual quality and performance of a service of the The same type that the client can reasonably expect, taking into account the nature of this and, where appropriate, the descriptions on the specific characteristics of the services made by CASAS PEPE.e) CASAS PEPE describes the details, technical characteristics and photographs of the properties provided by the owners thereof, so that it is not bound by these public statements.

2. The lack of conformity resulting from a service not performed or provided will be equated to the lack of conformity of the contract, provided that the responsibility for it falls on CASAS PEPE or under its responsibility; on the contrary, when the service not performed or provided is due to negligence or malpractice of the USER, it will not be considered any fault of CASAS PEPE and will be considered in accordance with the terms of the contract.

3. Liability shall not apply for lack of conformity that the USER knows or could not have ignored at the time of conclusion of the contract or that have their origin in information provided by the USER.

 

Responsibility of CASAS PEPE

The PROVIDER will respond to the USER for any lack of conformity that exists at the time of delivery of the accommodation. CASAS PEPE recognizes the USER the right to repair the service, its replacement, the price reduction and the termination of the contract.

 


13. APPLICABLE LAW AND JURISDICTION

These conditions will be governed or interpreted in accordance with Spanish legislation in that which is not expressly established. CASAS PEPE and the USER agree to submit to the courts and tribunals of the USER's domicile any dispute that may arise from the provision of the products or services subject to these Conditions.

In the event that the USER is domiciled outside Spain, the PROVIDER and the USER expressly waive any other forum, submitting to the Dispute Resolution Body that will act as an intermediary between them in accordance with Art. 14.1 of Regulation (EU) 524/2013, without the need to resort to the courts of justice.
